古韵 User Service Agreement
Dear user:
古韵 Company (hereinafter referred to as "古韵" or "古韵 Shopping") provides services for you to use the 古韵 platform (reference definition) in accordance with the provisions of this "古韵 Service Agreement" (hereinafter referred to as "this Agreement"). This agreement provides services between users (reference definition) and 古韵 Company and is legally binding!
Please read this agreement carefully. The terms that exempt or limit liability will be displayed in bold and users should read them carefully. Unless users have read and accepted the terms of this agreement, users have no right to use the services provided by 古韵. After users click the "Confirm" button below the original version of this agreement and successfully register as a user according to the 古韵 platform registration procedure, it is deemed that the user has fully read and accepted all the terms of this agreement. This agreement will take effect immediately and is binding on both parties.
1. Confirmation and acceptance of this agreement
1. The content of this Agreement includes the main text of the Agreement and all kinds of rules, guidelines and agreements that have been published or may be published in the future by the 古韵 platform (hereinafter referred to as "all kinds of rules"). All kinds of rules are an integral part of the Agreement and have the same legal effect as the main text of the Agreement.
2. 古韵 platform has the right to formulate and modify this Agreement or various rules at any time as needed. If there are any changes to this Agreement, 古韵 platform will publish an announcement on the 古韵 website to notify users. If users do not agree to the relevant changes, they must stop using the "Service". Once the modified agreement is published on the 古韵 platform, it will automatically take effect. All kinds of rules will take effect once they are published and become part of this Agreement. Users' login or continued use of the "Service" constitutes acceptance of the modified agreement. Unless otherwise expressly stated, any new content that expands the scope or functionality of the "Service" is subject to this Agreement.
3. Please read the entire service agreement carefully before registering. If you have any questions, please consult the 古韵 platform.
4. The files referred to by the linked text in this agreement that are not marked with the word "rules" are still part of this agreement and users are also required to understand and comply with them. They are binding on users.
2. Definitions
1. Users and user registration
Users include buyers and sellers. Users must be natural persons with full civil capacity or entities with legal business qualifications. If a user is a minor under the age of 18 and uses 古韵 platform services, they must obtain the prior consent of their parents or guardians. If any person without civil capacity, person with limited civil capacity, or organization without business or specific business qualifications improperly registers as a 古韵 platform user or if a 古韵 user engages in transactions that exceed the scope of their civil rights or capacity, 古韵 has the right to require the user and his or her guardian, or organization to bear responsibility.
2. 古韵 Platform
古韵 Platform: refers to the platform established by 古韵 Company to provide buying and selling services to users, including PC and mobile client platforms such as 古韵 website, 古韵 Overseas Mall, 古韵 Overseas Shopping Tool, etc. 古韵 Platform is only used as an online trading platform, as a place for users to find trading partners, negotiate commodity and service transactions, and obtain various transaction-related services. 古韵 Platform itself does not participate in buying and selling activities as a user (buyer or seller).
3. Services
古韵 provides: (1) all services related to transactions on the 古韵 platform, including but not limited to using the 古韵 platform to publish transaction information, query item information, participate in online group purchases, enter into sales contracts with other users, evaluate the credit of other users, participate in activities related to the 古韵 platform, and have the right to enjoy other related information services provided by the 古韵 platform; (2) publish instant messages, emails and advertisements to users; (3) other services that 古韵 deems necessary
3. User Rights and Obligations
1. Account Registration
(a) refers to the process in which a user logs in to the 古韵 platform, fills in relevant information as required, and confirms that he agrees to perform the relevant user agreement. Users have the right to have their own user name and transaction password on the 古韵 platform, and have the right to use their own user name and password to log in to the 古韵 platform transaction platform at any time. Users shall not borrow, transfer or authorize others to use their 古韵 platform user name without authorization, otherwise the user shall bear all responsibilities arising therefrom and shall bear joint and several liability with the actual user; 古韵 reserves the right to warn, (eventually) stop providing part or all of the services of this platform to users, and freeze and cancel user accounts at its discretion.
2. Registration Information
(a) Users are obliged to provide their true information when registering and ensure the validity and security of email addresses, contact numbers, contact addresses, zip codes, etc., to ensure that the 古韵 platform and other users can contact them through the above contact information. At the same time, users are also obliged to update the relevant registration information in a timely manner when the relevant information actually changes. Users promise not to register or authenticate on the 古韵 platform with other people's information. If the registration information provided by the user is untrue, invalid, illegal or incomplete, or 古韵 has reasonable grounds to suspect that the registration information provided by the user is untrue, illegal or incomplete, 古韵 has the right to refuse or terminate (interrupt) part or all of the services provided by the user to the 古韵 platform at its own discretion.
(b) Users should update their user information in a timely manner and keep their account and password properly. If a user fails to update information in a timely manner or fails to keep their account properly, resulting in the user being unable to use the service normally or suffering from the account being stolen, the user shall not use this as a reason to cancel the transaction or refuse payment, and 古韵 shall not bear any responsibility.
3. User Code of Conduct
(a) Users understand and agree that if they use the services in their personal 古韵 accounts in a manner suspected of fraud, in violation of the principle of good faith, or in other ways that violate these Terms or other public terms (including but not limited to buying and selling personal accounts, red envelopes, discount coupons, etc.; using cheating software or other improper means to obtain points and coupons; stealing other people's accounts; frequently registering accounts with the same IP address; multiple people recharging the same account, etc.), 古韵 has the right to refuse to continue to provide services and may take measures to freeze the user's account. Depending on the specific circumstances, the platform has the right to invalidate or clear all funds obtained from the user's account due to the above-mentioned behavior.
(b) Users shall ensure that they abide by the principle of honesty and trustworthiness when using the 古韵 platform for transactions, do not engage in unfair competition during transactions, do not disrupt the normal order of online transactions, and do not engage in behaviors unrelated to online transactions.
(c) Users shall not make malicious comments on other users on the 古韵 platform, or take unfair means to improve their own credit or reduce the credit of other users.
(d) Users shall not publish any illegal or illegal information on the 古韵 platform.
(e) Users shall not buy or sell items on the 古韵 platform that are prohibited or restricted by the state, or items that infringe on the intellectual property rights or other legitimate rights of others, or items that are contrary to the public interest or public morality, or items that 古韵 deems unsuitable for sale on the 古韵 platform. (f) Users agree not to commercially exploit any data on the 古韵 platform without 古韵's prior written approval, including but not limited to using any materials displayed on the 古韵 platform by copying, disseminating, etc.
(g) All tax liabilities and all hardware, software, service and other expenses arising from transactions, use of paid services or access to 古韵 platform servers shall be borne by the user.
(h) When users publish product information on the 古韵 platform, they must promise that the purchased products are from legal sources and there are no counterfeits! If this basic commitment is violated, 古韵 and the affected users will reserve the right to resort to foreign local laws or Chinese laws to obtain compensation.
4. User Violation Handling
(a) 古韵 has the right to review the user's registration information and transaction behavior. If there are any problems or doubts in the registration information or transaction behavior, 古韵 has the right to send inquiries, correction notices, or directly delete them.
(b) For improper behavior of users on the 古韵 platform or any other situation that 古韵 believes should terminate the service, 古韵 has the right to delete relevant information, terminate the provision of services, etc. at any time without the user's consent.
(c) 古韵 has the right to revoke the user's registration information on the 古韵 platform created by maliao.
